Two active-duty Marines pleaded guilty on Monday to Capitol riot-related criminal charges. Both pleaded guilty to a misdemeanor count of parading, demonstrating, or picketing in a Capitol building, according to a spokesperson for the US Attorney's Office for the District of Columbia. Coomer pleaded guilty to the same misdemeanor charge in May and is scheduled to be sentenced by Reyes on Aug. 30. The angles of the photos and the caption indicated he had been inside the Capitol on Jan. 6, the FBI said. Approximately 600 have pleaded guilty, mostly to misdemeanors punishable by maximum imprisonment of six months or one year.

The preventive approach to domestic terrorism goes back even further than the 1990s and it begins with the basic police work and surveillance of the joint terrorism task forces. In fact, there is no section of the U.S. Criminal Code that criminalizes domestic terrorism as such. The absence of clear law around domestic terrorism, and the imperatives of prevention, mean that investigators and prosecutors who work domestic terrorism cases must focus on more common charges: weapons violations, illegal drug possession, burglary, aiding and abetting and so forth. But this was not enough to overrule the fear of domestic terrorism that was gripping the nation and that hung in the courtroom. It reflected the legal paradoxes of the case and domestic terrorism law in general or, maybe more accurately, the absence of it.

The complaint says that since at least early 2021, McKillips had been posting messages insinuating or explicitly threatening to harm the government or federal agents. McKillips was arrested on criminal complaint charges of unlawful possession of a machine gun and interstate communication of threats, the FBI said. That profile posted a photo of an AR-15 style rifle fitted with a grenade launcher on Jan. 14, 2021, the complaint said. On July 6, 2021, a confidential source reported that McKillips had posted recordings in a Signal chat room talking about burning down federal buildings and shooting federal agents.
